Phil Ivey Files Counter Suit in $9.6 Million Borgata Edge Sorting Case

Phil Ivey (cover image) is back in the news with another legal development in the one of the cheating cases against him. This time, once again, the ten-time bracelet winner has decided to take the offensive and has filed a countersuit against the Borgata Casino in the $9.6 Million suit that has been pending in the courts. Ivey is now alleging that the casino has destroyed the cards they claim were used for cheating and have thus, denied him the chance to bring the cards in as evidence and prove the cheating case wrong.

The case had begun in April, 2014, when the Borgata had alleged that Ivey, along with the help of accomplices, “Queen of Sorts” Cheung Yin Sun had used the “edge sorting” technique to cheat the casino of $9.6 million in baccarat earnings. Sun and Ivey identified the cards through minor defects and used the knowledge for winning hands. It was then alleged that Ivey had specifically asked for these particular cards, knowing of the defects beforehand.

Now Ivey and Sun are alleging that the Borgata has fraudulently or through negligence disposed of the Gemaco-made cards, denying them a chance to prove their innocence. The counter suit is seeking the case be dismissed on frivolous grounds and compensatory damages, consequential and punitive damages and “any other relief the court deems equitable and just.”

Ivey had also filed a suit against the Crockford’s Casino in the London High Court last November, but the presiding Judge had ruled in favor of the casino, albeit while calling Ivey a “honest man” who did not realize it was cheating. Ivey’s counter case against Crockford’s is still pending.
