Irish Judge Rules Gamblers Have No Legal Guarantee of Getting Paid

Punters winning big in casinos have no protection in law if operators fail to pay out, according to a judge who dismissed one man’s claim to thousands of euro based on laws dating back to 1956.

In a legal action brought on by Ireland resident Sayed Mirwais, the plaintiff argued that D1 Casino in Dublin refused to pay him his winnings in full. On the night of March 2, Mirwais claimed that D1 Casino, of 63/64 Lower Dorset Street, Dublin, had refused to pay him €11,713 that he had won after placing several bets on an automated roulette machine.

He had first won about €7,500. When he had wanted to cash it out, he was allegedly given €2,500 in cash and €5,000 worth of chips, before being told to play more and he would be paid at the end of the night.

The court heard that after he won a further €6,713, he was told by a manager to cash out. When he had gone to the cashier counter he was told the casino had no more cash for the night but that he would be paid the following day. He was also told that an engineer would later check the roulette machine.

Counsel for the casino believed that there was a suspiciously high amount of money lost by the roulette machine. Mirwais denied there had been a flaw in the machine but Judge Comerford relied on the Gaming and Lottery Act 1956 which states that no action shall lie for the recovery of any money or thing which is alleged to be won.

Passing his verdict on the situation, the judge stated, “If you happen to be too lucky while placing a bet or gambling, the person can simply say ‘no you’re not entitled to the money. That is simply the law in Ireland,”

The name of the show might ring a bell for many of the poker veterans, as there was a show with a similar title “2 Months, 2 Million” which featured high-stakes pros, namely Emil “Whitelime” Patel, Jay “pr1nnyraid” Rosenkrantz, Dani “Ansky” Stern and Brian “flawless_victory” Roberts, who were sharing a house in Las Vegas and grinding around the clock. Even though they couldn’t reach their goal, the show was a big hit and entertained many fans around the globe.

In what will be a huge commitment, the three Unibet ambassadors will be updating the vlog every Wednesday and Friday the entire year, sharing their profits/losses on a weekly basis for complete transparency. The transparency doesn’t just apply to their poker lives but also their real lives as, in their own words, “There will be downswings, in both life and poker”.

Apart from grinding for weeks on end in Taallin, Estonia, the three friends will also travel the world together playing poker.

It will certainly be interesting to follow their progress over the next 12 months!
